The purpose of this assessment is to help you develop an understanding of the contexts for sustainable HRM.

Guidelines for essay preparation

An essay requires a thesis statement, a body of argument and evidence and a conclusion.

A thesis statement is responsive to the question – identifying the topic of the essay, indicating a “position” with regard to the question, and suggesting the line of reasoning which will be developed in the essay. T

he body of the essay develops and supports the thesis – makes points in support of the thesis and supports those points with evidence (for example, expert opinion, examples, anecdotes, data, research findings, etc.).

The stringing together of quotes is not a line of reasoning nor is jotting down points under sub-headings.

Subheadings in an essay are a convenience, but an essay can – and must – be able to be understood without them. It is your responsibility as the author to ensure that your line of reasoning and your evidence are comprehensible to the reader; it is not the reader’s responsibility to do your thinking – make your connections – for you.

Also, be aware that the material presented in the body of the essay should be explained and critically evaluated, whether quotes, data, summaries of research, examples, anecdotes, etc.

Finally, an essay has a conclusion which draws together and summarises the ideas and line of reasoning presented in the essay and makes some meaningful statement with regard to the thesis as it has been developed in the essay.

In effect, the parts of the essay are responsive to the following questions:

1.Thesis statement: What is your short answer to the question?

2.Body of the essay: How do you arrive at that answer? What is your line of reasoning and your evidence for it?

3.Conclusion: What should the reader conclude from what you have presented?

Assessment guidelines for essay

Essay assignments are assessed on three major aspects:

1. Content

Have you read and understood the issues and concepts raised in the assigned materials in journals and from other sources you may have found? You demonstrate this by raising and critically discussing these issues and concepts in your assignments in response to the questions asked. It is expected that you will cite many, if not all of the relevant assigned readings in your assignment.

Readings are assigned to raise issues and concepts considered important from an educational point of view (they provide you with tools of analysis, evidence, comparison) and/or from practitioner point of view (they raise topics of importance for the current and future management of staff). You are expected to address them.

2.Analysis

Are you able to use evidence (examples, data, research findings, etc.) to explore critically the concepts and issues and draw appropriate conclusions? Please note that use of quotes is often regarded as very weak evidence. If you use your own workplace as an example or if you are asked to write in a context of your own organisation, please be advised that markers are less interested in a description of your workplace situation Page 16 of 26 Version: than in your ability to apply the concepts and issues to that workplace. In other words, focus mainly on the issues and concepts, not on your workplace. This part is very important for your level of study and hence a very high weightage is allocated.

3.3. Presentation Before submitting your assignment it is advisable to review it. Have you written an essay or report? Do you develop points in a clear and logical fashion? Can your line of reasoning be followed? Are your citations and references in proper format? Have you corrected spelling and punctuation errors? Have you written in non-discriminatory language? It doesn’t matter how much effort you put in on an assignment if the product is unsatisfactory. The only way markers know if you know something is by your ability to communicate it clearly. It is your job as the writer of the assignment to communicate what you know. It is not the job of the reader to try and figure out what you mean. A good test of whether or not your essay is well written and addresses the question is to ask someone to read it and tell you what the question is you are attempting to answer. If they cannot identify the specific topic, it is likely that you haven’t answered the question. Also ask them to explain what they saw as your major points and conclusion. If they cannot identify these, it is likely that you haven’t accomplished what you set out to do. Further, you should ask them if the evidence persuaded them and the line of reasoning you offered to support your conclusions. If not, then it is likely that you have not supplied satisfactory evidence and/or not developed a satisfactory line of reasoning. For those of you uncertain about what is required in an essay format, you will find numerous books in any university or public library on this subject. It is suggested that you read several of the assigned readings for how the author presented his/her line of reasoning as well as for what s/he had to say on the topic. How did s/he tell you what the article was about? How did s/he develop the line of reasoning? How did s/he move from one paragraph to another smoothly? What sort of evidence was presented to support each point? Was the evidence credible? How did s/he directly support his/her point? How did s/he deal with information or evidence that actually contradicted or did not support the point? How did s/he conclude the article?

There are three parts to this assignment.

Part One

The First Amendment actually says, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” Our Founding Fathers were very familiar with the writings of John Locke, and the need to keep government and religions separate was just as important to them as guaranteeing the toleration of different religious beliefs.

  • What were Locke’s three primary reasons for keeping government and religion separate? Which one of those reasons do you think is the most applicable today, and why?
  • Part Two

    Many people misread the First Amendment and think it is advocating “freedom from religion” rather than “freedom of religion.” They use this misreading to ban symbols of religion from public places.

  • From what you know about Locke, explain whether or not you think that Locke’s view of religious toleration would require the removal of religious symbols from the public view. Be sure to provide evidence for your position that is based on logical reasoning rather than emotional reactions. Feel free to quote from the textbook to support what you believe would be Locke’s position concerning the government prohibiting the display of religious symbols.
  • Also, based on what Locke has said, do you think there ever could be times that it would be legitimate for the government to suppress a religion or some of their beliefs because of that religion’s extreme practices—even if what they are doing is not breaking the law? Why or why not?
  • Part Three

    Regardless of how you answered the second question, Mill (a father of Liberalism) insists that progress and happiness (for both the individual and society) is only possible when each person is able to express himself openly and fully about the things important to him. The criticism of this liberal view is that left to our own devises, the diversity in our pursuits of individual goals and interests will lead to disputes, and, thus, rules and regulations are needed to allow individuals to develop their goals within a more structured society and so they can learn their social obligations to the community as a whole. The problem with liberalism, the critics say, is that by making our ability to choose for ourselves the highest objective, we may embrace the notion of diversity, but we are no longer interested in tolerating differences or even in considering how to integrate the diversity of ideas into a cohesive society made up of individuals. Ultimately, then, following this line of thought, the toleration of a diversity of religions leads to a disunity within the community and a disinterest in social responsibility.

  • If the above conclusions about liberalism are true, would restricting religious diversity to five or six major religions in the United States still give people a choice in how they worship but also eliminate some of the religious divisiveness which separates people (whether through stereotyping or other forms of prejudice) and prevents the citizenry as a whole from viewing itself as a single nation in which we all cooperate and work together for the common good? In other words, is all of this religious toleration actually dividing us even further rather than uniting us as a society? Be sure to explain your thinking with examples and detailed reasons.

    You have been assigned to assist Attorney Adams and Legal Assistant Ameche in organizing the Johnson case.     There are two important hearings to schedule for this case. They all have to be for times and dates when Judge Kalend is available, as the local rules assign one judge to hear all hearings on a case. Adams and Ameche have written out recommended hearing dates for this case on the erasable board and you are assigned to check the proposed dates. At your suggestion, they have now practiced calculating dates for hearings, using Microsoft Excel, after service of notices. They used a demo calendar file to practice. Then, they did one on the Johnson case, but did not complete the work. You can do a “save as” to try different dates if needed and still not lose the first part of their proposed plan.

    The first hearing has to be on a date that allows you to serve a three business day written notice to the other side. Service was made on January 2, 2015. The typed notice has to include the date of the hearing. Assume that a three business day notice under the rules requires you to serve a notice on the opposing attorney three days in advance of the hearing. You cannot count Saturdays, Sundays, and Monday holidays, and cannot count the date of service of the notice (delivery to the other law firm by one of your staff), but you do count the date of the hearing.

    To better answer the assignment questions, imagine doing this for many cases. Think of how you might do this manually, with Microsoft Excel, or with a high-end legal calendaring software.

    The judge has now notified your office that you can have another hearing, but must give a 14 day notice to the opposition. This notice period does allow you to count Saturdays, Sundays, and Holidays, as long as the 14th day is not on a Saturday, Sunday, or Holiday. Do not count the date of service, but do count the 14th day. Assume that you cannot schedule or serve notice of the second hearing until the day after the first hearing is completed. The date of the hearing has to be the first time Judge Kalend is available, after you have given the correct notice.

    Using the attached Excell Sheet, format the hearing dates and all other data in the correct sheet rows in red.

    Also, Attorney Adams has accepted a case that involves a series of harassment incidents over a long period of time at a job site. The employer is one of the defendants. To get maximum recovery, the timing of several separate incidents will need to be shown. The timing of employer responses and training need to be shown as well and be matched up with incidents. The employer claims that prompt action, remediation and training remedies were done, but the victims are claiming “too little, too late.”

    It is going to be hard to get a jury to “see” the timing. Please explain in a 2 to 3 page Legal Memorandum for Attorney Adams how a time map software product may help. What brand of time line software do you recommend? Give a second choice. What are some pros and cons of each?
